Data will be processed for the purpose :
- of the conclusion and performance of the contract concluded with the Controller and the necessary settlements for its conclusion, and the legal basis for the processing of personal data is Article 6(1)(b) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27.04.2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (hereinafter: GDPR), as this is necessary for the performance of the contract with you. Data for this purpose will be processed for the time necessary for the conclusion and subsequent performance of the contract and then for the time necessary to demonstrate the proper performance of the resulting obligations until the expiry of the limitation periods for claims;
- to perform the Controller’s statutory duties, in particular tax and accounting duties, and the legal basis for the processing is Article 6.1c of the GDPR, as it is necessary to perform the Controller’s legal duties resulting from, among others, the Accounting Act of September 29th 1994 (i.e. Journal of Laws of 2019, item 351 as amended), the Corporate Income Tax Act of February 15th 1992 (i.e. Journal of Laws of 2019), item 865 as amended) – for the period resulting from the above mentioned provisions of law, in particular until the expiry of the limitation period for tax liabilities (in principle, it will be 5 years, counting from the beginning of the year following the financial year in which the deadline for payment of tax related to the service provided expired);
- of the determination, investigation or defence against the claims, and the legal basis for the processing is Article 6(1)(F) of the GDPR, as this is necessary to pursue the legitimate interest of the Controller with the same content – for the period of limitation of the claims related to the Company’s cooperation with you,
- of building relations and image, including maintaining contact with customers and communicating information about the Controller’s cooperation with a you to the public or third parties, and the legal basis for the processing is Article 6(1)(F) of the GDPR, as it is necessary to pursue the Controller’s legitimate interest, i.e. the implementation of PR activities and building the Controller’s brand on the market – for the duration of the cooperation between you and the Controller and the time when communicating information about the existing cooperation will have a positive impact on building the Controller’s image, not longer than until you raise a justified objection to further processing,
- of sending information about the Controller’s offer, and the legal basis for the processing is Article 6 par. 1 letter F of the GDPR, as it is necessary to realize the Controller’s legitimate interest in the form of sale of his or her own services – until a justified objection to their processing or expression of no interest in the offers submitted by the Company is raised, but not longer than for the duration of cooperation between you and the Company and the period of your probable interest in the Company’s services in the future.
The data of persons acting on your behalf (employees, co-workers) will be processed for the purposes indicated in point 1. 2-5 above and for the purpose of contacting a supplier through his/her employees or co-workers , which is a legitimate interest of the Controller in the form of maintaining current contacts with the Company’s customers for the duration of the relationship between a supplier and the Controller.
You have the right to access, rectify and request deletion of data, as well as the right to restrict processing, the right to transfer and the right to object to data processing.
Additionally, a supplier has the right to lodge a complaint with the President of the Office for Personal Data Protection, ul. Stawki 2, 00-193 Warszawa, if, in your opinion, a supplier’s data is being processed contrary to the principles of personal data protection.
The recipients of your personal data may be: companies from the Transition Technologies capital group in case another company from the group is necessary for the execution of the agreement concluded with a supplier, IT provider, hosting, entity providing accounting services, financial and legal advisors.
The controller does not plan to transfer your personal data to recipients outside the EEA, i.e. to third countries. However, such a situation may occur if the involvement of other companies from the Transition Technologies capital group is necessary to implement the agreement concluded with a supplier. In this case, your personal data may be transferred to Transition Technologies group companies based in the USA or Taiwan. The transfer of your personal data is permissible in view of Article 49(1)(c) of the GDPR, i.e. in case the transfer is necessary for the performance of the agreement between the data subject and the Controller.
Additionally, you have the right to lodge a complaint with the Inspector of Personal Data Protection, ul. Stawki 2, 00-193 Warszawa.
There will be no automated decision-making, including profiling, in connection with the processing of your personal data.
The provision of personal data by a supplier is voluntary, but it is a condition for the conclusion of the agreement and may be a condition for its proper performance, and failure to provide such data will prevent a supplier from concluding an agreement with the Company and the provision of services by the Controller.
The provision of personal data for the purpose of sending information about the Controller’s offer is voluntary and a refusal to provide it will not entail any consequences for a supplier.
